“We deserve better than the Employment Non-Discrimination Act.”

Writing in The Guardian, our own Jos Truit says it’s time to make a unified push for comprehensive, inclusive anti-discrimination “legislation that actually has teeth.”

Forty years ago last week, Bella Abzug introduced the Equality Act in Congress, which would have amended the Civil Rights Act to include protections from discrimination based on sexual orientation in housing, public accommodations and employment. The Employment Non-Discrimination Act, or ENDA, which covers employment discrimination, was introduced 20 years later, in 1994.

Breaking: Senate passes Employment Non-Discrimination Act

With a vote of 64-32, earlier today the Senate passed the Employment Non-Discrimination Act (ENDA), which bans workplace discrimination based on sexual orientation and gender identity, making it the first time in history the institution has voted to include LGBT people in a non-discrimination law.

Though legislating equality has incredibly valid critiques, and it might be difficult to get this bill through the House (Speaker Boehner has openly opposed ENDA), this remains, as VP Biden would say, a big fucking deal.

In light of today’s hearing on Employment Non-Discrimination Act (ENDA), it’s worth addressing the argument made by ENDA critics that protecting civil rights is just too gosh-darn expensive and will lead to all sorts of frivolous law suits. One, that’s a pretty indefensible argument, even if ENDA did cost money. Two, discriminating against people based on their sexuality and identification is pretty expensive as this Center for American Progress infographic illustrates. So, ENDA critics, don’t hide behind economic arguments. Just embrace your inner bigot.
