Today is Veteran’s Day, when we celebrate those who serve our country and who risk their lives to do it. Fittingly, there are several Veteran’s Day events happening today in New York tonight to commemorate the service of LGBT Americans and to discuss the current state of the policy that makes it legal to fire them for being LGBT.

DADT Update: Court of Appeals issues stay requested by Obama administration

What the fuck:

A three-judge panel of the U.S. Court of Appeals for the Ninth Circuit has issued a temporary stay of U.S. District Judge Virginia Phillips’s Oct. 12 order in Log Cabin Republicans v. United States halting all enforcement of the military’s “Don’t Ask, Don’t Tell” policy.

After DADT had been halted from enforcement for nearly 200 hours, the Ninth Circuit order legally makes DADT enforceable again for the time being.

In a brief order, Judges O’Scannlain, Trott and W. Fletcher wrote:

The Obama Administration (via the Justice Department) had asked the courts to place a stay (aka don’t enforce this yet) on the ruling from Judge Virgina Phillips that had placed an injunction on dismissals and investigations of military members based on the DADT policy. Yesterday she tentatively denied the stay. The military responded by tell recruiters to accept openly gay and lesbian applicants.

Lt. Dan Choi, a major player in the fight against DADT, re-enlisted this afternoon as an openly gay member of the military.

Don’t Ask, Don’t Tell ruled unconstitutional by federal court

Last night, a California federal court ruled that the Don’t Ask, Don’t Tell policy which prohibits gays and lesbians from serving openly in the military is unconstitutional.

Via CNN:

“Plaintiff has demonstrated it is entitled to the relief sought on behalf of its members, a judicial declaration that the Don’t Ask, Don’t Tell Act violates the Fifth and First Amendments, and a permanent injunction barring its enforcement,” concluded U.S. District Judge Virginia Phillips, a 1999 Clinton appointee.

This ruling comes amidst Congressional ability to pass a repeal of DADT, something that the House has already done and activists are putting pressure on the Senate to follow suit. The court ruling is likely to be in the appeals process ...
