A translation of the Supreme Court’s arguments against marriage equality

The Supreme Court is hearing oral arguments on California’s Prop 8, the law banning same-sex marriage in California. Because legalese is hard to understand, I’ve translated some of the arguments made against marriage equality, and one of the arguments made for it, from yesterday’s hearing.

1. Justice Samuel Alito kvetched to the Solicitor General Donald Verrilli,  “Traditional marriage has been around for thousands of years. Same-sex marriage is very new…. But you want us to step in and render a decision based on an assessment of the effects of this institution which is newer than cell phones or the Internet? I mean we — we are not — we do not have the ability to see the future.”

Republican Senator Rob Portman changes his mind on marriage equality because of his gay son

In a moving tribute to his son Will, who is gay, Ohio Sen. Rob Portman announced his support of marriage equality. The celebrated conservative senator, once on the short list to become Mitt Romney’s running mate in 2012, writes in a column published today in The Columbus Dispatch:

This just in: The National Organization for Marriage, also known as Gay-Haters Against Civil Rights, is now courting gays in its fight against gay marriage. So spread the word and help them recruit! Because if we learned anything from politics over the last few years, it’s that discriminatory beliefs are much more palatable when they are espoused by a member of the minority group most affected. Oh, and that  divide and conquer ALWAYS works.

Vice President Joe Biden is known for his gaffs. But this time, he should stick by what he said. On Meet The Press,  Biden expressed his full support for same-sex marriage, outdoing Obama, who supports civil unions, saying:

“I am absolutely comfortable with the fact that men marrying men, women marrying women, and heterosexual men and women marrying another are entitled to the same exact rights, all the civil rights, all the civil liberties. And quite frankly, I don’t see much of a distinction beyond that.”

National Organization for Marriage memos reveal same ‘ol racial wedge strategy

Surprise! The National Organization of Marriage uses race as a strategic wedge issue in the debate over marriage equality.

A confidential memo obtained by the Human Rights Campaign outlines the strategy to divide along racial lines stating (Via The Daily Beast):

“The strategic goal of this project is to drive a wedge between gays and blacks—two key Democratic constituencies,” it said. “We aim to find, equip, energize and connect African-American spokespeople for marriage, to develop a media campaign around their objections to marriage as a civil right; and to provoke the gay marriage base into responding by denouncing these spokesmen and women as bigots.”
