LGBT immigrants may face difficulty applying for marriage-based visas

Folks who know me know that I have pretty complicated political feelings about marriage equality, but when DOMA died the first thing that I thought of was queer immigrants – particularly, that those who were married to U.S. citizens and would now be eligible to be petitioned for by their spouses for permanent residency. While the percentage of queer immigrant folks who would be able to take advantage of this is probably quite low, any relief or good news in this mess of a national immigration conversation feels like a big deal.  But of course, the process won’t be as simple as it would be for straight folks. Seth over at Colorlines details some concerns ...

Marriage equality’s hip hop theme song

The rap duo Macklemore and Ryan Lewis has broken records with their hits “Thrift Shop” and “Can’t Hold Us.” And now, with their pro-marriage equality hit “Same Love,” which features out lesbian Mary Lambert, they’re shattering stereotypes.

Just as “Same Love” supported this movement, the recent Supreme Court rulings on DOMA and Prop 8 are helping the song become an even greater hit. The song hit the charts in February, when several states were voting on marriage equality and the Supreme Court was considering challenges to DOMA and Prop 8. Wednesday, when the Supreme Court ruled on  both cases, “Same Love” rose to No. 28 on the Billboard Hot 100 chart, up from No. ...

Quick Hit: The woman behind the SCOTUS DOMA case

Today The New York Times published a profile of Edith Windsor, a friendly-looking 83-year-old New Yorker in pink and pearls whose fight against the Defense of Marriage Act, which “requires the federal government to deny marital benefits to gay and lesbian couples who live in states that allow such unions,” has made it to the U.S. Supreme Court.

The article covers Windsor’s 40-year relationship with her late wife Thea Spyer and touches on the tricky matter of why the couple’s lasting commitment made this the ideal case, whether we like it or not, for lawyers to win over conservative judges:

…Legal experts said that [Windsor’s] age, the length and depth of her relationship, the way it can be viewed as a ...

Breaking: Democratic Party platform to include gay marriage plank

The Washington Blade reports that on Sunday Democrats approved draft language supporting same-sex marriage and other pro-LGBT positions as part of the Democratic Party’s platform. The process is not officially complete – the language will have to be approved in a full platform meeting, and then by the delegates at the Democratic National Committee Meeting. But the decision is basically final, according to reports. Barney Frank, who was part of the 15-member panel that voted on the language, said they unanimously backed the language.

More from the Blade:

A Democratic National Committee staffer, who is familiar with the process and spoke on condition of anonymity, said the language in the platform approved on Sunday not only backs marriage equality, but ...

Senator Kirsten Gillibrand pushes for DOMA repeal

It’s been a hell of a couple of days for advocates of LGBT rights around here. On Friday night, the New York State senate sent a passed marriage equality bill to the desk of Governor Andrew Cuomo, who signed it into law right away. And on Sunday, the streets of New York were filled with rainbow-clad revelers who had come from all over the world to participate in the annual Pride parade (and to get their hands on the hilarious freebies).

But, as the smoke – and the glitter and the confetti – clears, it’s time to start looking toward the next fight. And for many people, that fight is repealing the Defense of Marriage Act.

House GOP spending $500,000 in taxpayer money to defend DOMA

Remember how the GOP’s top priority right now is creating jobs? Oh wait, nevermind. Remember how the GOP’s top priority right now is reducing the deficit? I mean, as long as it’s done mainly solely by cutting spending, instead of raising taxes on the wealthy? Ya know, “make the tough choices,” “tighten our belts” and all that jazz? Remember that?

Well, here’s the latest update from the Hypocrisy Watch Unit of the Misplaced Priorities Department. The Huffington Post reports that House Republicans plan to pay an independent law firm up to $500,000 of taxpayer money to uphold the Defense of Marriage Act (DOMA) since the Obama administration instructed the Justice Department to stop defending it in February.

And as Joe ...

Breaking: Obama pronounces DOMA unconstitutional, asks DOJ to cease defending the law

Some great news, for a change:

Moments ago, in a sharp reversal of policy, the Obama administration announced that it believes that Section 3 of the 1996 Defense of Marriage Act (DOMA) — which prohibits the federal government from recognizing same-sex marriages — is unconstitutional and will ask the Justice Department to stop defending the law. In a press release announcing the change, U.S. Attorney General Eric Holder also argues that laws regarding sexual orientation should be subject to a higher level of review.

From the official DOJ statement by Attorney General Eric Holder:

In the two years since this Administration took office, the Department of Justice has defended Section 3 of the Defense ...
