Feminist Law Profs on the scariest line in Kennedy's opinion.
For background on the fight over the "partial birth" abortion ban, see Cynthia Gorney's piece, "Gambling with Abortion" (Harper's, November 2004). I think it's the best in-depth article ever written about abortion politics.
More recently, Scott Lemieux explained why this case matters. (He also warned us that Alito's confirmation pretty much guaranteed results like today's decision.)
The Center for Reproductive Rights (via ACSBlog) speculates as to what this means for the future of women's health.
Bean writes about what a motherfucker Kennedy is.
Dana Goldstein notices that as of 12pm, this story had yet to be major news on CNN.
John Edwards says he could not disagree more with the decision. Silence from Clinton and Obama. Rudy Giuliani says the court came to the "correct conclusion." UPDATE: NYT has all the candidates' statements. (Thanks, spark329.)
Planned Parenthood is planning a rally on the steps of the Supreme Court at 3pm today.

actually, clinton has released a statement, and it's the weakest of all the democratic candidates, to the suprise of no one. obama's is right on. as my friend pointed out, he may have actually read the decision. here are they all:
http://thecaucus.blogs.nytimes.com/2007/04/18/2008-candidates-on-the-abortion-ruling/
Thanks for the link to the candidates' statements. I had actually feared that no Democratic candidates would say anything at all, in the current climate of wanting to be "careful" and moderate and safe enough to be elected. Ditto what spark329 said, Obama's is the most heartening.
That "Gambling with Abortion" piece is excellent. I'm very glad I read it.
Jack Balkin has an excellent analysis -- a little more legalese but still very accessible -- here:

He does a really nice job of pointing out the logical fallacies and makeweight arguments in Kennedy's opinion.
Also, a good comment on the silver lining of this decision here: http://www.tpmcafe.com/blog/coffeehouse/2007/apr/18/todays_scotus_opinion_bad_news_and_better_news
I'm so frustrated about this that I've been reading articles on it all day long. Ugh...
I re-read an old article from 2004 that I remembered being one of my personal favorites on the subject of late term abortions. Here's the link for anyone interested...
http://www.boston.com/news/globe/magazine/articles/2004/01/25/my_late_term_abortion/
To be clear, the "Partial-Birth" Abortion Ban doesn't outlaw late-term procedures, it outlaws a certain method of performing abortions that is used as early as 13 weeks -- certainly not "late-term."
PPFA, NARAL, and NOW were all out at the Supreme Court at 3 o'clock. It was a good turn out, and very heartening to be together and angry in public. Hopefully the press, who were there, will cover it.
Thank you, Ann, for linking to Cynthia's Gorey's piece. It helped me tremendously. I feel like I finally have a grasp of this issue and can better inform others.
And thanks to Colleen for linking to the Boston article. What a story.
I really am at a loss right now. I have nothing to add other than to say that it is in precisely these times that communities such as Feministing prove absolutely essential and invaluable. I am truly grateful to be a part of this group. I'm in awe of how much I learn and am continually inspired to contribute and pass it along.
One more reason to move.
Preferably, to Australia.
this whole thing is a nightmare. does anyone know if there are any large-scale, national protests being planned?
(and the fact that my BF is from Australia in no way influences that decision! ;)
Seriously, is there any hope that this ruling will get reversed before a woman dies as a result? It's all so terrible.
